Illinois Mugshot Record Limits

Illinois FOIA, 5 ILCS 140, broadly treats documentary material held in public business as records, subject to exemptions. Personal privacy, active law-enforcement needs, and other statutes can affect access. The sheriff should identify the basis when it withholds all or part of a responsive record. Requesters should not claim an absolute right before that review occurs.

Illinois also limits some law-enforcement social-network publication. The Local Records Act provision at 50 ILCS 205/3b restricts agency posting of booking photos for specified low-level matters unless a listed public-safety purpose applies. A photo missing from social media may reflect that rule or agency policy. It is not proof that no booking image exists.

A person sentenced to Illinois prison may have an image on the IDOC Individual in Custody Search. That institutional image is not necessarily the photograph taken during the Logan County Jail booking. It also does not cover people released directly from the county jail after bond, pretrial release, dismissal, time served, probation, or a county sentence.

Compare the IDOC number, name, birth information, physical descriptors, commitment county, and sentence blocks. An image helps distinguish similar names, but the profile’s custody and date labels control the status question. “Projected Parole Date” is prospective. “Offender Status: PAROLE” with an actual parole date supports release from prison to supervision, while final discharge is a later and different event.
